•Returned purchases, disputed or unauthorized/fraudulent transactions, EMI’s and Card Account Fees will not be considered for calculating the Benefit this offer.

•Nothing contained herein shall prejudice or affect the terms and conditions of the card member agreement. The terms of the above schemes shall be in addition to and not in derogation of the terms contained in the card member agreement.

•In the event of any conflict with respect to the terms and conditions mentioned herein and the specific terms and conditions applicable to an offer selected by the Customer, the specific terms and conditions applicable to the selected offer shall prevail.
•This offer is non-cashable, not extendable, non-transferrable and non-negotiable.
•The eligibility criteria for this offer is subject to revision by TDPL at its sole discretion.
•Any customer found to be violating the terms and conditions applicable, shall be not eligible to claim benefit as applicable under the offer.
•The final amount of NeuCoins to be credited to the Customer shall be at the sole discretion of HDFC bank and TDPL and may differ from the indictive percentage as mentioned in any offer callout accessed through the above links.
•The NeuCoins under the Tata Neu HDFC Bank Credit Card Product Feature Benefit will be credited to the Customer within 7 (seven) days from the date of the subsequent credit card statement.
•TDPL reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change/ vary or withdraw the offers altogether or to vary/replace all these terms and conditions, wholly or in part, this offers by another offer, whether like this offer or not, or to extend or withdraw the offers altogether.
•Your participation in this offer is voluntary.
Services and Offers: You understand and acknowledge that HDFC Bank is not selling or rendering any of these offers/services. You also understand and acknowledge that HDFC Bank does not warrant or guarantee the quality, delivery, features, or availability of the services or offers provided by the TDPL, and that any dispute or claim regarding the offers/services must be resolved by you directly with the TDPL without any reference to HDFC Bank. HDFC Bank shall not be liable in any manner whatsoever if customer’s transaction fails due to technical issue. HDFC Bank and TDPL shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of any goods/ services / assured gifts / gift vouchers availed by the Customers under the said offer. HDFC Bank and/or TDPL shall not be held liable for any delay or loss that may be caused in delivery of the services.
Payment and Fees: Payments for any offers/services is directly made to the Partner App/website and HDFC Bank plays no role in payments made on partner platforms. You also agree to pay any applicable taxes, fees, or charges that may be levied by the Tata Digital Ltd., HDFC Bank, or any other authority in relation to your transactions. You understand and acknowledge that HDFC Bank is not liable for any payment failures, errors, delays, or refunds that may occur due to technical issues or other reasons beyond HDFC Bank's control.
Intellectual Property Rights: You acknowledge and agree that HDFC Bank and TDPL own and shall continue to own all rights, title, and interest in and to their respective trademarks, logos, names, designs, and other intellectual property rights (""IPR"") that are used in relation to the Program and offer. You agree not to use, copy, modify, display, or distribute any IPR without the prior written consent of HDFC Bank or TDPL. You also agree not to do anything that may infringe, dilute, or damage the IPR of HDFC Bank or TDPL. You agree not to disclose, copy, use, or allow access to any Information/Promotional Offer without the prior written consent of HDFC Bank or TDPL.
Limitation of Liability: You agree that HDFC Bank and TDPL are not liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages or losses arising from or in connection with the Program, the offers/services provided by TDPL, or the IPR, even if HDFC Bank or TDPL have been advised of the possibility of such damages or losses. You also agree that HDFC Bank's and TDPL's total aggregate liability under this Agreement will not exceed the amount paid by you to TDPL for the offers/services availed through the Program in the 1(one) month preceding the event giving rise to the liability.
Governing Law and Dispute Resolution: Your participation in this offer shall be governed by the laws of India. All disputes, if any, arising out of or in connection with or because of above offers or otherwise relating hereto shall be subject to the exclusive jurisdiction of the competent courts/tribunals in Mumbai only, irrespective of whether courts / tribunals in other areas have concurrent or similar jurisdiction.
